New OSHA Rule Takes a Hard Look at Post-Injury or Illness Drug Testing

On May 12, 2016, OSHA issued a new final rule, “Improve Tracking of Workplace Injuries and Illnesses.” The new rule, also known as the Electronic Recordkeeping rule, takes effect Jan. 1, 2017, and requires certain employers to electronically submit injury and illness data that they are already required to record on their onsite OSHA Injury and Illness forms. Furthermore, this new rule contains a precedent-setting OSHA position on non-federally mandated post-injury or illness drug testing.
